Recent Cases
Since the Firm's founding date of June 1, 1995, the Firm's partners have actively defended over 200 medical negligence lawsuits. Approximately 55% were dismissed by the plaintiff's attorney without payment, 25% were resolved through settlements approved by the physician and 15% were tried with a verdict on behalf of the physician. The Firm is particularly pleased with the rate at which cases have been dismissed without the need for trial or settlement. The Firm believes that its experience and attention to detail have contributed to these results.

As for regulatory compliance litigation, the Firm recently defended a physician who allegedly participated in a scheme to fraudulently bill the Medicare Program for hospice care provided in several Chicago area nursing homes. Other parties, including the President of the hospice, paid fines in excess of $10,000,000. In 2001, the Firm also successfully defended physicians in proceedings initiated by the Illinois Department of Public Aid and the Illinois Department of Professional Regulation.

Other recent physician cases have involved disputes regarding shareholder distributions, employment agreements, covenants not to compete, and the failure of a management service provider to collect billings in a reasonable manner. Additionally, the Firm has actively defended physicians whose privileges were subject to extensive peer review hearings initiated by Chicago area hospitals and HMOs.
